1. Overview

Welcome to Kaleshi Collective (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website www.kaleshicollective.com (the “Site”) and any purchases, interactions, or services offered through it.

By accessing or using the Site, placing an order, or engaging with our content or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using the Site.

This agreement is legally binding under the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable Indian laws. For international users, the Terms also comply with general e-commerce and consumer protection standards.

2. Eligibility

You must be at least 18 years old to use our services. By using the Site, you represent that:

  • You are legally capable of entering into binding contracts.

  • You are not barred from using our services under any applicable laws.

  • If accessing the Site on behalf of a business or entity, you are authorized to bind that entity to these Terms.

3. Account Creation and Security

You may create an account to streamline your purchases. You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Immediately notifying us of any unauthorized use

We reserve the right to suspend or terminate any account suspected of violating these Terms or engaging in fraudulent behavior.

4. Product Information and Availability

We take reasonable care to ensure that product descriptions, images, pricing, and stock availability are accurate. However, we do not guarantee:

  • The exact appearance of products on all screens

  • The availability of any product at the time of purchase

  • That there will be no typographical, pricing, or other errors

We reserve the right to modify or discontinue products at any time without prior notice.

5. Pricing and Payments

All prices are listed in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) where applicable. You agree to:

  • Provide valid and accurate payment information

  • Pay all applicable charges incurred through your account

  • Authorize us to charge your selected payment method

We use secure, third-party payment gateways (such as Shopify Payments, Razorpay, PayPal) and do not store your full credit/debit card details.

6. Order Acceptance and Cancellation

6.1 Order Confirmation

Once you place an order, you will receive an automated confirmation email. This confirmation does not signify acceptance of your order. We reserve the right to:

  • Accept or decline your order for any reason

  • Cancel any order prior to shipping, including for pricing errors, stock issues, or suspected fraud

6.2 Order Cancellation by You

If you wish to cancel an order, please contact us immediately. Cancellations are only possible before the item has shipped. Once shipped, the order is considered final and non-cancellable.

7. Shipping, Delivery, and Risk of Loss

We currently ship across India. Delivery times are estimated and not guaranteed, though we strive to dispatch all orders within 2–5 business days.

  • Shipping charges are calculated at checkout

  • A tracking number will be provided once the order is dispatched

  • Risk of loss passes to the buyer once the order is handed over to the shipping carrier

8. Returns and Refunds

Returns and refunds are governed exclusively by the Kaleshi Collective Return and Refund Policy. We accept returns only if the item is unused, in original condition, or if the product is defective, damaged, or incorrect. All return requests must be submitted within seven (7) calendar days of delivery to admin@kaleshicollective.com with supporting evidence as required.

9. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, designs, slogans, photographs, videos, and software — is the exclusive intellectual property of Kaleshi Collective or its licensors and is protected under the Indian Copyright Act, 1957 and international copyright laws.

You agree not to:

  • Copy, reproduce, distribute, or create derivative works

  • Reverse engineer or tamper with the site’s code

  • Use any trademarks or brand marks without prior written permission

Violations may result in legal action, including damages and injunctions.

10. User Content

If you tag or submit content (e.g., reviews, photos, testimonials, social media mentions), you grant Kaleshi Collective a royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, and display such content for marketing or promotional purposes.

You confirm that any such content:

  • Does not infringe upon third-party rights

  • Is not obscene, defamatory, or unlawful

  • Is your original creation or shared with full permissions

11. Promotions, Discounts, and Store Credit

Any offers, coupons, or discounts provided by Kaleshi Collective:

  • Are non-transferable and not redeemable for cash

  • Are valid only for the time and products specified

  • Cannot be retroactively applied to previous orders

Store credit issued as refunds or rewards expires 12 months from the date of issue unless otherwise stated.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Kaleshi Collective shall not be liable for:

  • Any indirect, incidental, special, or consequential damages

  • Losses resulting from delays in delivery or third-party errors

  • Errors or inaccuracies in product descriptions or pricing

Our total liability for any claim arising from your use of the Site or our services shall not exceed the amount paid by you for the relevant product(s).

13. Indemnification

You agree to indemnify, defend, and hold harmless Kaleshi Collective, its directors, employees, agents, and affiliates from and against any third-party claims, liabilities, damages, losses, or expenses arising from:

  • Your breach of these Terms

  • Your misuse of the Site

  • Your violation of any law or third-party right

14. Force Majeure

We shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, strikes, supply chain disruptions, or internet outages.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, without regard to conflict of law principles.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised “Last Updated” date. Continued use of the Site after changes are posted constitutes acceptance of those changes.

17. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice or liability, for any reason including but not limited to:

  • Breach of these Terms

  • Misuse of services

  • Fraudulent activity

All provisions that by their nature should survive termination shall survive, including those relating to intellectual property, liability, and dispute resolution.
